Your chances of getting your money back

Be sure to respond to the claim and meet the deadlines set, otherwise a default judgment looms. Check (or have checked) whether the underlying termination was even valid.
In the case of termination without notice due to payment arrears, full back payment within the grace period can render the termination invalid. In addition, you can apply for an eviction period and, in cases of special hardship, enforcement protection (§§ 721, 765a ZPO).

What you should do now

  1. 1

    1. Meet deadlines

Respond to the claim on time; do not let hearings and pleadings lapse.

  2. 2

    2. Check the termination

Was the termination valid (form, grounds, notice period)? The eviction can fail on that.

  3. 3

    3. Use the grace period

In case of payment arrears, full back payment within the grace period can cure the termination without notice.

  4. 4

    4. Eviction/enforcement protection

Apply for an eviction period and, in cases of special hardship, enforcement protection (§§ 721, 765a ZPO).

Frequently asked questions

What happens if I do not respond to the eviction claim?

Then a default judgment looms, with which the landlord can enforce the eviction. So be sure to respond on time. In parallel, have it checked whether the termination was valid; if it is not, the eviction claim can be dismissed. Get legal support as early as possible.

Can I still avert the eviction?

In the case of termination without notice due to payment arrears, full back payment within the statutory grace period can render the termination invalid. You can also apply for an eviction period and, in cases of special hardship, enforcement protection (§§ 721, 765a ZPO). Whether that applies in your case should be checked by a lawyer.
