Titled claim: why it remains enforceable for 30 years
If a claim has been titled, that is, established by a judgment, enforcement order, or notarial deed, the short limitation no longer applies. Titled claims become time-barred only after 30 years and can be enforced again and again during this time. You should know this in order to react correctly.

What you should do now
- 1
1. Check the title
Clarify what the title is based on (judgment, enforcement order, notarial deed) and whether it is correct.
- 2
2. Recalculate the amount
Check the principal claim, interest, and costs. Interest makes the debt grow over the years.
- 3
3. Offer a solution
Offer the creditor a realistic installment payment or a settlement in order to avoid enforcement.
- 4
4. Check protection/insolvency
In the case of particular hardship, apply for enforcement protection; in the case of permanent over-indebtedness, examine a personal insolvency with discharge of residual debt.
How to spot the scam
- You assume the claim is settled after three years, with a title this is not correct.
- The debt grows unnoticed through ongoing interest.
- Enforcement measures come years after the title.
Frequently asked questions
How long is a titled claim enforceable?
Titled claims, for example from a judgment or enforcement order, become time-barred only after 30 years (§ 197 BGB). During this time the creditor can enforce again and again. The short regular limitation of three years does not apply here.
Does the debt keep growing?
Yes, as a rule. Default interest continues to run on the titled principal claim, plus enforcement costs. Over the years the debt can thereby increase significantly. An early solution saves money.
What options do I have?
An installment payment or a settlement with the creditor, enforcement protection in the case of particular hardship, and, in the case of permanent over-indebtedness, personal insolvency with discharge of residual debt. Debt counseling helps to find the right path.
