Equal status with severely disabled people: protection from a GdB of 30
Even with a degree of disability (GdB) of 30 or 40 you can have yourself given equal status with severely disabled people. Equal status gives you important protective rights at work, above all special protection against dismissal, if you can thereby keep or obtain your job.

What you should do now
- 1
1. Check the GdB notice
You need an established GdB of at least 30. If it exists, equal status comes into consideration.
- 2
2. Application at the agency
File the application for equal status at the Employment Agency and justify the connection to the job.
- 3
3. Set out the job connection
Make clear that, due to the disability, you see the job endangered without equal status or find it harder to obtain.
- 4
4. Use the protection
After equal status, the special protection against dismissal applies; additional leave for severely disabled people, however, is not covered by it.
How to spot the scam
- A dismissal is looming and you have not yet applied for equal status.
- The job connection is not made clear in the application.
- You confuse equal status (protection) with the severely disabled person's pass (from GdB 50).
Frequently asked questions
What does equal status get me?
Above all the special protection against dismissal: a dismissal of your employment relationship then requires the prior approval of the integration office. Certain support measures and the special protection at the workplace also apply.
From which GdB is equal status possible?
From a degree of disability of 30 (up to below 50). The prerequisite is that, without the equal status, you cannot obtain or keep a suitable job due to the disability (§ 151 SGB IX).
Where do I apply for equal status?
At the Employment Agency. Attach the GdB notice and justify the connection to your job. File the application early, ideally before a dismissal looms.
