Degree of disability (GdB) too low? An objection is often worthwhile

The pension office assessed your degree of disability (GdB) lower than expected, or denied the application? A GdB of 50 brings important compensatory benefits (for example, additional leave, protection against dismissal, a tax allowance). An objection is often worthwhile.

Create an objection

Your chances of getting your money back

You can file an objection against the assessment decision within one month (§ 84 SGG). After that it becomes final.
The procedure is free of charge (§ 183 SGG). Often individual conditions are not rated, or rated too low, or not properly combined into an overall GdB, which can be challenged.

What you should do now

  1. 1

    1. Check the decision

Which conditions were rated with which individual GdB? Are diagnoses missing, or is the formation of the overall GdB not comprehensible?

  2. 2

    2. File an objection within the deadline

File an objection in writing within one month. You can submit the reasoning with findings later.

  3. 3

    3. Submit current findings

Submit current medical findings and reports that prove your impairments, and release the doctors from their duty of confidentiality.

  4. 4

    4. Use advice

Social associations (VdK, SoVD) and disability advice services support free of charge with the objection.

Frequently asked questions

Is an objection against the GdB worthwhile?

Often yes. Especially the rating of several conditions and the formation of the overall GdB are error-prone. With current findings the GdB can often be raised, which can trigger important compensatory benefits (for example, from GdB 50, the status of severe disability).

How long do I have?

One month from notification of the decision (§ 84 SGG). File an objection to preserve the deadline and submit current medical findings later. The procedure is free of charge; social associations help.
