Frequently asked questions
What is the difference between a model declaratory action and a redress action?
In a model declaratory action, an association first only has fundamental legal questions clarified; you may then have to enforce the specific claim yourself. The redress action, possible since the end of 2023, goes further: the association can sue directly for performance, for example damages or a refund, so that after a success you are as a rule compensated directly.
What does taking part cost me?
Registration in the action register at the Federal Office of Justice is free, and you bear no litigation cost risk of your own; the suing association takes that on. The registration also suspends the limitation period for your claims. You only need to observe the registration deadline in the respective proceedings.
