Can I reduce the rent if the elevator is broken?
Yes, if the elevator belongs to the rented property and fails significantly or permanently. That is a defect that can entitle you to a rent reduction (§ 536 BGB). How high the reduction is depends on the impairment; on higher floors or with limited mobility it is considerably greater. Report the failure and reduce the rent under reservation.
Does it matter which floor I live on?
Yes. The higher your apartment is, the more an elevator failure impairs your use; this affects the amount of the permissible rent reduction.
