What you should do now
- 1
1. Check the deployment period
How long have you been with the same hirer? Equal pay applies after 9 months at the latest.
- 2
2. Make a comparison
What do comparable core employees earn? That is the benchmark for your claim.
- 3
3. Assert the claim
Ask the temp agency (your employer) in writing to pay the wage difference in arrears, observing any exclusion periods.
- 4
4. Get advice
Unions and advice centers offer support. In a dispute, the labor court has jurisdiction.
Frequently asked questions
From when am I entitled to equal pay as a temporary worker?
After nine months of deployment at the latest with the same hirer, equal pay applies, that is, the entitlement to the same pay as comparable core employees (§ 8 AÜG). Collective agreements in temporary work can modify this within limits; sector supplements often apply earlier.
Who do I direct my claim to?
To your employer, which is the temp agency (the lender), not the business where you are deployed. Demand the wage difference in writing and watch for exclusion periods in the employment or collective agreement.
