Objection / next steps

Your chances of getting your money back

Sick pay is paid for the same illness for a maximum of 78 weeks. After that (Aussteuerung), depending on the situation, unemployment benefit (even if you are still ill) or an application for a reduced earning capacity pension comes into consideration.
If the sick pay is cut early (for example due to an assessment), you can file an objection within one month (§ 84 SGG); the procedure is free (§ 183 SGG).

What you should do now

  1. 1

    1. Secure gapless sick notes

Make sure the incapacity to work is certified without any gap (best on the last day of validity), otherwise a gap in your entitlement threatens.

  2. 2

    2. Apply for a follow-up benefit

Register in good time with the employment agency (seamless unemployment benefit) or check an application for a reduced earning capacity pension.

  3. 3

    3. Object to an early cut

If the sick pay is cut before the Aussteuerung, file an objection on time and submit medical findings.

  4. 4

    4. Use advice services

Independent patient counseling, social associations and the health insurer itself inform you about the next steps.

Frequently asked questions

How long is sick pay paid?

For the same illness a maximum of 78 weeks within three years (minus periods of continued pay from the employer). After that comes the Aussteuerung. Gapless sick notes are important so that no entitlement is lost.

What comes after the Aussteuerung?

Depending on the situation, unemployment benefit, which under certain circumstances is available even if you are still unable to work (seamless rule), or a reduced earning capacity pension. Register early with the employment agency and check the pension application.
