Having a divorce granted abroad recognized in Germany

A divorce granted abroad does not automatically apply in Germany. So that you are considered divorced here and can, for example, remarry, a recognition procedure is needed depending on the country of origin. Simplifications apply to EU divorces.

Foreign divorce decisions generally have to be formally recognized in Germany; the respective state justice administration is responsible (§ 107 FamFG). Only then does the divorce become effective here.
Divorces within the EU (except Denmark) are usually recognized without a special recognition procedure. Outside the EU, the procedure at the state justice administration is required.

Frequently asked questions

Does my foreign divorce automatically apply in Germany?

Only EU divorces (except Denmark) generally apply without a further procedure. Divorces from non-EU states must be formally recognized in Germany before they are effective here; the state justice administration is responsible (§ 107 FamFG).

Why is recognition important?

Without recognition, you are still considered married in Germany. That has consequences for civil status, remarriage, use of name, inheritance law, and taxes. Only with recognition does the divorced status become effective here.

How long does the procedure take?

That depends on the country, the documents, and the authority, and can take several months. Complete, translated documents with a certificate of finality speed up processing.
