Workplace accident: how to secure your claims

You had an accident at work or on the way there? The statutory accident insurance (Berufsgenossenschaft) is responsible, with special benefits. It is important that the accident is reported correctly and recognized as a workplace accident.

Objection / recognition

Your chances of getting your money back

In a workplace or commuting accident, the Berufsgenossenschaft pays for medical treatment, injury benefit and possibly an accident pension. You have a right to treatment by a designated accident doctor (Durchgangsarzt).
If the accident is not recognized as a workplace accident or a benefit is denied, you can file an objection within one month (§ 84 SGG); the procedure is free (§ 183 SGG).

What you should do now

  1. 1

    1. Report the accident

Report the accident to your employer; they must notify the Berufsgenossenschaft. See a designated accident doctor promptly.

  2. 2

    2. Document the sequence of events

Record when, where and how the accident happened and name witnesses. This is important for recognition.

  3. 3

    3. Object to a denial

If the Berufsgenossenschaft does not recognize the accident or denies benefits, file an objection on time.

  4. 4

    4. Use advice services

Social associations (VdK, SoVD) and unions provide free support, including in a lawsuit before the social court.

Frequently asked questions

What counts as a workplace accident?

Accidents during the insured activity and on the direct route to/from work (commuting accident). The Berufsgenossenschaft is responsible, not the health insurer. It pays for medical treatment, possibly injury benefit and, in the case of lasting consequences, an accident pension.

What can I do if recognition is denied?

File an objection within one month (§ 84 SGG) and prove the sequence of events and consequences with evidence (D-doctor's report, witnesses). The procedure is free; social associations and unions help.
