A person who operates a commercial business.
A merchant within the meaning of commercial law is a person who operates a commercial business. Special rules of the Commercial Code (HGB) apply to merchants, for example on form, duties to inspect and give notice, and commercial customs. Many consumer protection rules do not apply between merchants.
