Criminal Capacity
The capacity to be held criminally responsible.
A person has criminal capacity if they can recognize the wrongfulness of an act and act according to that insight. Children under 14 are not criminally responsible. In the case of mental disorders, criminal capacity can be excluded or diminished, which affects criminal liability.
