Necessity
A justification in a situation of danger.
A person who acts in the face of a present danger in order to protect a more valuable legal interest can be justified (justifying necessity, § 34 StGB). In civil law there are similar rules on interfering with another's property to avert danger. The limits must be examined closely in each individual case.
